THIS IS A WAIVER OF YOUR RIGHTS

YOU HAVE A DUTY TO READ THIS WAIVER, RELEASE, INDEMNIFICATION, AND HOLD HARMLESS AGREEMENT ("AGREEMENT") IN ITS ENTIRETY BEFORE AGREEING. YOUR FAILURE TO DO SO WILL NOT EXCUSE YOU FROM BEING BOUND BY THIS AGREEMENT.

ASSUMPTION OF RISK: In consideration for the Boise Bighorns Lacrosse Club granting me permission to participate in this lacrosse athletic sports program, related events and activities, including travel to and from (the "Event"), and in acknowledgement that these activities involve certain inherent risks, dangers and hazards which can result in serious personal injury, permanent paralysis or death, I hereby freely agree to assume and accept any and all known and unknown risks of the injury while participating in the Event. I further recognize and acknowledge that the risks inherent in the sport of lacrosse can be greatly reduced by conditioning, ownership of proper equipment, abiding by game rules and personal discipline.  I further agree and acknowledge that the Releasees (as defined hereinafter) have no duty or obligation whatsoever to assess or analyze whether I am fit to participate in the Event or whether it is appropriate for me to do so.

RELEASE AND WAIVER OF CLAIMS: In consideration of the Boise Bighorns Lacrosse Club allowing me to participate in the Event, I hereby agree as follows: 

TO RELEASE WAIVE ANY AND ALL CLAIMS that I have or may in the future have against the Boise Bighorns Lacrosse Club, Lacrosse Idaho, Meridian Parks & Recreation, any sponsors of the club or league, and all of their respective members, employees, coaches, officers, board members, owners, contractors, sponsors, advertisers, agents, and if applicable, owners and lessors of premises used to conduct events, as well as all other players participating in this lacrosse athletic sports program (collectively, the "Releasees") resulting from or relating to my participation in the Event.

INDEMNIFICATION AND HOLD HARMLESS AGREEMENT: I FURTHER AGREE TO RELEASE, INDEMNIFY AND HOLD HARMLESS the above-described Releasees from any and all liability or any loss, damage, injury or expense that I may suffer, or that my next of kin may suffer, as a result of my participation in the Event due to any cause whatsoever, including negligence or breach of contract on the part of the Releasees in the operation, supervision, design, or maintenance of lacrosse, games, activities or fields.

Participation in the Event shall be deemed to include any of my conduct that takes place at any time which constitutes, relates, or practically facilitates the act playing lacrosse in the league. 

BINDING EFFECT OR AGREEMENT: In the event of my death or incapacity, this Agreement shall be effective and binding upon my heirs, next of kin, executors, administrators, assigns and representatives.

ENTIRE AGREEMENT: In entering into this Agreement, I am not relying upon any oral or written representations other than what is set forth in this Agreement.

I AM AWARE THAT BY SIGNING THIS AGREEMENT (BY CLICKING THE AGREEMENT BOX BELOW) I AM WAIVING CERTAIN LEGAL RIGHTS INCLUDING THE RIGHT TO SUE THE RELEASEES AND ANY LEAGUE, ENTITY, OR PERSON HEREIN NAMED OR REFERRED TO. I willingly agree to comply with the stated and customary terms and conditions for participation. If however, I observe any unusual, significant hazard during my presence or participation, I will remove myself from participation and bring such to the attention of the nearest official

CHOICE OF LAW: In the event of a dispute related to this Agreement or your participation in this Event, the laws of the State of Idaho will govern.

JURISDICTION: Any lawsuit related to this Agreement or your participation in this Event must be filed in Ada County, Idaho.

REMEDIES:  In the event of any dispute related to his Agreement or your participation in this Event, your sole remedy shall be limited to a refund of the purchase price of your registration.

SEVERABILITY:   If any provision of this Agreement is held to be invalid, void or unenforceable, the balance of its provisions will, nevertheless, remain in full force and effect and will in no way be affected, impaired or invalidated.

HEADINGS:  The headings in this Agreement are for convenience or reference only, and shall not limit, expand, modify or otherwise affect the meaning hereof.

By completing this transaction, you are certifying that:

1. The player/participant possesses active health insurance.

2. You, the participant, are 18 years old or older, you have read the Agreement, and have accepted it in its entirety;

This is to certify that I, as parent or guardian with legal responsibility for this participant, do consent and agree to his release, as provided above, and for myself, my heirs, assigns, and next of kin. I release and agree to indemnify and hold the RELEASEES from any and all liabilities incident to my minor childs involvement or participation in these programs as provided above, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASEES.

DO NOT SIGN UP FOR WINTER BOX SERIES IF YOU DO NOT AGREE TO THE FOREGOING TERMS.  BY CHECKING THE BOX, I AM CONFIRMING MY ACCEPTANCE OF THIS AGREEMENT AND EACH AND EVERY OF ITS TERMS.
